Welcome to Dolce Store! The terms “we”, “us” and “our” refer to Dolce Store. Dolce Store operates this store and website, including all related information, content, features, tools, products and services offered in connection with orders, with the aim of providing you (the customer) with a curated shopping experience (the “Services”). Dolce Store is powered by Shopify, which enables us to provide the Services to you.

These Terms and Conditions, together with any policies referenced herein (collectively, the “Terms of Service” or “Terms”), set out your rights and responsibilities when using the Services.

Section 3 – Orders 
When you submit an order, you are making an offer to purchase. Dolce Store reserves the right to accept or reject your order for any reason at its sole discretion. Your order is not accepted until Dolce Store confirms acceptance. We must receive and process your payment before accepting your order. Please carefully review your order before submission, as Dolce Store may not be able to fulfil cancellation requests after an order has been accepted. If we do not accept, change or cancel an order, we will attempt to notify you using the email address, billing address and/or phone number you provided when placing the order.

Products you purchase may only be returned or exchanged in accordance with our Refund Policy [link].

Your purchase is for your personal or household use only and may not be used for commercial resale or export.

Section 4 – Prices and Billing 
Prices, discounts and promotions may change without prior notice. The price charged for products or services will be the price in effect at the time your order is submitted and will be stated in your order confirmation email. Unless otherwise expressly stated, published prices do not include taxes, shipping, handling, duties or import fees.

Prices published in our online store may differ from those offered in physical stores, online stores or other stores operated by third parties. You represent and warrant that (i) the credit card information you provide is true, correct and complete, (ii) you are fully authorised to use such credit card for the purchase, (iii) charges incurred by you will be honoured by your credit card company, and (iv) you will pay the charges incurred by you at the published prices, including shipping and handling charges and all applicable taxes (if any).

Section 5 – Shipping and Delivery  
We are not responsible for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs processing or events beyond our control. Title and risk of loss pass to you once we transfer the goods to the carrier.

Section 6 – Intellectual Property 
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, videos and audio, and the design, selection and arrangement thereof, are owned by Dolce Store, its affiliates or licensors, and are protected by United States and foreign patent, copyright and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any material from the Services without our prior written consent. The name, logo, product and service names, designs and slogans of Dolce Store are trademarks of Dolce Store or its affiliates or licensors. You may not use such trademarks without the prior written permission of Dolce Store. The name, logo, product and service names, designs and slogans of Shopify are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are the trademarks of their respective owners.

Section 7 – Optional Tools  
As part of the Services, you may be given access to customer tools provided by third parties over which we have no monitoring, control or involvement.

You acknowledge and agree that we provide access to such tools on an “as is” and “as available” basis, without any warranties, representations or conditions of any kind, and without any endorsement. We shall have no liability arising from or related to your use of optional third-party tools.

Your use of optional tools offered through this website is entirely at your own risk and discretion, and you should ensure that you are familiar with and agree to the terms on which such tools are provided by the relevant third-party provider.

Dolce Store is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases made in our store are made directly with Dolce Store. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Dolce Store, including any injury, damage or loss arising from the purchase of products and services. You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Dolce Store.

In addition, you agree not to: (a) upload or transmit viruses or any other malicious code that may affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, pretext, spider, crawl or scrape the Services; (e) use any robot, spider, scraper, data mining or extraction tool, automated device or process, AI tool (such as agentic AI) or automated or manual method to access the Services; or (f) interfere with, bypass or circumvent any security or authorisation features, robot exclusion headers or other measures we use to restrict access to the Services. If we determine that you have violated any part of these Terms, we reserve the right to suspend, disable or terminate your account at any time without prior notice.

Section 17 – Limitation of Liability  
To the fullest extent permitted by law, Dolce Store, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors, or Shopify and its affiliates’ respective personnel, shall not be liable for any claim arising from or related to your use of any Services or any products purchased through the Services, including but not limited to any errors or omissions in any content, or any loss, damage or injury of any kind arising from the use of the Services or any content (or products) posted, transmitted or otherwise made available through the Services, or any direct, indirect, incidental, punitive, special or consequential damages of any nature, including but not limited to loss of profits, loss of revenue, loss of savings, loss of data, cost of replacement or any similar damages, whether based on contract, tort (including negligence), strict liability or otherwise, even if advised of the possibility of such damages.

You agree to indemnify, defend and hold harmless Dolce Store, Shopify and their affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from and against any losses, damages, liabilities or claims (including reasonable attorneys’ fees) payable to any third party arising out of or resulting from: (1) your breach of these Terms of Service or any documents incorporated by reference; (2) your violation of any law or infringement of any third-party right; or (3) your access to and use of the Services.

We will notify you of any claim subject to indemnification, provided that failure to give timely notice will not relieve you of your obligations except to the extent you are materially prejudiced thereby. We may control the defence and settlement of such claims (including choice of counsel) at your expense, but we may not settle any claim that requires you to assume non-monetary obligations without your consent (which shall not be unreasonably withheld). You shall cooperate in the defence of any indemnified claim, including by providing relevant documents.

If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the jurisdiction in which Dolce Store’s headquarters is located, and the federal and state or territorial courts of that jurisdiction. You and Dolce Store agree that such courts shall have jurisdiction and personal jurisdiction.
